Bu koşullar, exAI mobil uygulamasını ve ilgili web sayfalarını (“Hizmet”) kullanımını düzenler. Hizmet'i kullanarak bu koşulları ve Gizlilik Politikası'nı kabul etmiş olursun.
exAI terapi, tıbbi tedavi veya kriz hizmeti değildir. Kendine veya başkasına zarar verme düşüncen varsa ya da hayati bir tehlike söz konusuysa hemen 112'yi ara veya en yakın acil servise git. Türkiye dışındaysan bulunduğun ülkenin acil numarasını ara.
1. Hizmet ve taraflar
Hizmet, [ŞİRKET UNVANI / AD SOYAD] (“exAI”, “biz”) tarafından sunulur. exAI; ayrılık ve ilişki süreçlerinde duygularını ifade etmene, mesajlarını değerlendirmene ve düşüncelerini toparlamana yardımcı olan, yapay zeka destekli bir sohbet ve analiz uygulamasıdır.
2. Yaş ve hesap
Hizmet'i kullanmak için en az 18 yaşında olmalısın.
Hesap bilgilerinin doğru olmasından ve hesabının güvenliğinden sen sorumlusun. Hesabının yetkisiz kullanıldığını düşünürsen bize hemen haber ver.
Hesabını kişisel kullanımın içindir; başkasına devredemez veya satamazsın.
3. Profesyonel tavsiye değildir
exAI bir doktor, psikolog, psikiyatrist, terapist, avukat veya başka bir lisanslı uzman değildir. Hizmet'teki hiçbir içerik tıbbi, psikolojik, hukuki veya finansal tavsiye, teşhis ya da tedavi niteliği taşımaz. Ruh sağlığınla ilgili bir sorun yaşıyorsan bir uzmana başvur. exAI sana seçenekler sunabilir; ancak kararları sen verirsin ve sonuçlarından sen sorumlusun.
4. Acil durumlar
exAI acil müdahale veya kriz yönetimi için tasarlanmamıştır; seni gerçek zamanlı izlemez ve konumunu bilmez.
Hayati tehlike, intihar düşüncesi veya kendine zarar verme riski varsa 112 Acil Çağrı'yı ara. Şiddet, tehdit veya ısrarlı takip durumlarında 155 (Polis), 156 (Jandarma) veya KADES uygulamasını kullanabilirsin.
Uygulamanın kriz belirtilerini fark etme özelliği yanılabilir; hiçbir zaman acil bir aramanın yerine geçmez.
5. Yapay zeka çıktıları
Yanıtlar, yapay zeka modelleri tarafından olasılıklara dayanarak otomatik üretilir. Hatalı, eksik, güncel olmayan, taraflı veya bağlam dışı olabilir.
Başka bir kişinin duygu, niyet veya davranışına dair analizler tahmindir; gerçeği yansıttığı garanti edilmez. Önemli kararları yalnızca bu çıktılara dayandırma.
Çıktıları kullanırken kendi değerlendirmeni yap ve başkalarının haklarına saygı göster.
6. Kabul edilebilir kullanım
Hizmet'i şu amaçlarla kullanamazsın:
Başkalarını taciz etmek, tehdit etmek, takip etmek, manipüle etmek, aşağılamak veya onlara zarar vermek;
Başkalarının özel mesajlarını veya kişisel verilerini hukuka aykırı şekilde elde etmek, paylaşmak veya ifşa etmek;
Nefret söylemi, şiddet, cinsel istismar (özellikle küçüklerle ilgili her türlü içerik) veya yasa dışı faaliyetler üretmek ya da planlamak;
Hizmet'i tersine mühendislikle çözmek, güvenlik önlemlerini veya kullanım limitlerini aşmaya çalışmak, otomatik araçlarla toplu istek göndermek, reklam ödül sistemini kötüye kullanmak;
Hizmet'i veya çıktılarını, rakip bir ürün geliştirmek veya model eğitmek için kullanmak.
Bu kurallara aykırılık hâlinde içeriği kaldırabilir, özellikleri kısıtlayabilir veya hesabını kapatabiliriz.
7. İçeriğin
Hizmet'e girdiğin içeriğin sahibi sensin. Bize, bu içeriği yalnızca Hizmet'i sana sunmak (yanıt üretmek, analiz etmek, kaydetmek, paylaşım linki oluşturmak) amacıyla ve Gizlilik Politikası'na uygun şekilde işleme izni verirsin. Yüklediğin içerik için gerekli haklara sahip olduğunu kabul edersin. Bir analizi link ile paylaşırsan, linke sahip herkesin içeriği görebileceğini bilirsin.
8. Abonelikler ve ödemeler
Premium, haftalık, aylık veya yıllık otomatik yenilenen abonelik olarak sunulur. Güncel fiyatlar ve kapsam, satın almadan önce uygulamada mağazanın gösterdiği yerel fiyatlarla gösterilir.
Ödeme, satın alma onayıyla birlikte Apple ID veya Google Play hesabından tahsil edilir. Faturalandırma tamamen Apple veya Google tarafından yapılır; kart bilgilerini görmeyiz.
Abonelik, mevcut dönem bitmeden en az 24 saat önce iptal edilmezse aynı süre ve fiyatla otomatik olarak yenilenir; yenileme ücreti dönem bitimine 24 saat kala tahsil edilir.
Ücretsiz deneme sunulursa, deneme bitimine en az 24 saat kala iptal etmediğin sürece deneme sonunda ücretli aboneliğe dönüşür. Deneme süresinin kullanılmayan kısmı, abonelik satın alındığında geçersiz olur.
İptal: iPhone'da Ayarlar → [adın] → Abonelikler; Android'de Google Play → Profil → Ödemeler ve abonelikler → Abonelikler. İptal, mevcut dönemin sonunda geçerli olur; o zamana kadar Premium'u kullanmaya devam edersin. Uygulamayı silmek veya hesabını silmek aboneliği iptal etmez.
İadeler Apple veya Google'ın iade politikalarına tabidir ve doğrudan onlardan talep edilir. Anında ifa edilen dijital hizmetlerde cayma hakkı, ilgili mevzuatın izin verdiği ölçüde uygulanmaz; tüketici olarak kanundan doğan hakların saklıdır.
Premium, makul kullanım (adil kullanım) limitlerine tabidir. Fiyatları ve abonelik kapsamını ileride değiştirebiliriz; fiyat değişiklikleri mağaza kurallarına uygun şekilde önceden bildirilir.
9. Reklamlar ve kullanım hakları
Ücretsiz sürümde günlük kullanım limitleri vardır ve reklam gösterilebilir. Ödüllü reklam izleyerek ek kullanım hakkı kazanabilirsin. Kullanım hakları ve ödüller kişiseldir, devredilemez, nakit değeri yoktur ve günlük olarak sıfırlanır. Limitleri ve ödülleri Hizmet'in sürdürülebilirliği için değiştirebiliriz.
10. Fikri mülkiyet
exAI adı, logosu, tasarımı, yazılımı ve içerikleri bize veya lisans verenlerimize aittir. Sana, bu koşullara uyduğun sürece Hizmet'i kişisel ve ticari olmayan amaçla kullanman için sınırlı, münhasır olmayan, devredilemez ve geri alınabilir bir lisans veriyoruz.
11. Fesih
Hesabını dilediğin zaman uygulamada Ayarlar → Hesabı sil yoluyla silebilirsin (ayrıntılar). Bu koşulları ciddi şekilde ihlal etmen, Hizmet'i kötüye kullanman veya yasal bir zorunluluk hâlinde hesabını askıya alabilir veya kapatabiliriz. Hizmet'i tamamen sonlandırmamız hâlinde makul bir süre önceden bildirim yaparız.
12. Sorumluluğun sınırlandırılması
Hizmet “olduğu gibi” ve “mevcut olduğu şekliyle” sunulur; kesintisiz, hatasız veya belirli bir amaca uygun olacağı garanti edilmez. Yürürlükteki hukukun izin verdiği azami ölçüde; dolaylı zararlardan, kâr veya veri kaybından ya da yapay zeka çıktılarına dayanarak verdiğin kararlardan sorumlu değiliz ve toplam sorumluluğumuz, talepten önceki 12 ayda bize ödediğin tutarla sınırlıdır. Bu sınırlamalar, kast veya ağır ihmalden doğan sorumluluğu ve tüketici mevzuatından kaynaklanan, sözleşmeyle sınırlandırılamayan hakları etkilemez.
13. Apple'a ilişkin hükümler
Uygulamayı Apple App Store'dan indirdiysen, Apple'ın standart Lisanslı Uygulama Son Kullanıcı Lisans Sözleşmesi (EULA) da geçerlidir. Bu koşullar sen ve exAI arasındadır, Apple ile değil; uygulamanın bakımı, desteği ve içeriğinden Apple değil biz sorumluyuz. Apple ve iştirakleri bu koşulların lehine üçüncü taraf yararlanıcılarıdır ve koşulları sana karşı uygulama hakkına sahiptir.
14. Değişiklikler
Bu koşulları güncelleyebiliriz. Önemli değişiklikleri uygulamada veya e-postayla önceden duyururuz. Değişiklikten sonra Hizmet'i kullanmaya devam etmen, güncel koşulları kabul ettiğin anlamına gelir.
15. Uygulanacak hukuk ve uyuşmazlıklar
Bu koşullar Türkiye Cumhuriyeti hukukuna tabidir. Uyuşmazlıklarda [ŞEHİR] mahkemeleri ve icra daireleri yetkilidir. Tüketiciysen, Tüketicinin Korunması Hakkında Kanun uyarınca yerleşim yerindeki Tüketici Hakem Heyetleri ve Tüketici Mahkemeleri'ne başvurma hakkın saklıdır. AB'de yaşayan tüketiciler, yaşadıkları ülkenin emredici tüketici koruma hükümlerinden yararlanmaya devam eder.
These terms govern your use of the exAI mobile app and related web pages (the “Service”). By using the Service you accept these terms and our Privacy Policy.
exAI is not therapy, medical treatment or a crisis service. If you are thinking about harming yourself or someone else, or anyone's life is in danger, call your local emergency number now (112 in Türkiye and the EU, 911 in the US, 999 in the UK) or go to the nearest emergency department.
1. The Service
The Service is provided by [COMPANY NAME / FULL NAME] (“exAI”, “we”, “us”). exAI is an AI-powered chat and analysis app that helps you express your feelings, look at your messages more clearly and organise your thoughts during breakups and relationships.
2. Age and account
You must be at least 18 years old to use the Service.
You are responsible for keeping your account information accurate and your account secure. Tell us right away if you suspect unauthorised use.
Your account is for your personal use; you may not transfer or sell it.
3. Not professional advice
exAI is not a doctor, psychologist, psychiatrist, therapist, lawyer or any other licensed professional. Nothing in the Service is medical, psychological, legal or financial advice, diagnosis or treatment. If you are struggling with your mental health, please reach out to a qualified professional. exAI can offer options, but you make the decisions and are responsible for their consequences.
4. Emergencies
exAI is not designed for emergency response or crisis management; it does not monitor you in real time and does not know your location.
If there is a risk to life, suicidal thoughts or a risk of self-harm, call your local emergency number. You can also find free, confidential helplines in your country at findahelpline.com (e.g. 988 in the US, Samaritans 116 123 in the UK and Ireland).
The app's crisis-detection feature can be wrong and never replaces an emergency call.
5. AI output
Responses are generated automatically by AI models based on probabilities. They may be wrong, incomplete, outdated, biased or out of context.
Analyses of another person's feelings, intentions or behaviour are guesses and are not guaranteed to reflect reality. Don't base important decisions on them alone.
Use your own judgement and respect other people's rights when using any output.
6. Acceptable use
You must not use the Service to:
harass, threaten, stalk, manipulate, demean or harm anyone;
unlawfully obtain, share or expose other people's private messages or personal data;
create or plan hate speech, violence, sexual exploitation (in particular anything involving minors) or illegal activity;
reverse-engineer the Service, circumvent security measures or usage limits, send automated bulk requests, or abuse the rewarded-ad system;
use the Service or its output to build a competing product or train models.
If you break these rules we may remove content, restrict features or close your account.
7. Your content
You own the content you put into the Service. You allow us to process it only to provide the Service to you (generate responses, analyse, store, create share links) and in line with our Privacy Policy. You confirm you have the rights needed for content you upload. If you share an analysis via link, anyone with the link can see it.
8. Subscriptions and payments
Premium is offered as an auto-renewing weekly, monthly or yearly subscription. Current prices and what's included are shown in the app, in your local currency as provided by the store, before you buy.
Payment is charged to your Apple ID or Google Play account at confirmation of purchase. Billing is handled entirely by Apple or Google; we never see your card details.
Your subscription renews automatically for the same period and price unless cancelled at least 24 hours before the end of the current period; the renewal is charged within 24 hours before the period ends.
If a free trial is offered, it converts to a paid subscription at the end of the trial unless you cancel at least 24 hours before it ends. Any unused part of a free trial is forfeited when you purchase a subscription.
Cancel: on iPhone, Settings → [your name] → Subscriptions; on Android, Google Play → Profile → Payments & subscriptions → Subscriptions. Cancellation takes effect at the end of the current period, and you keep Premium until then. Deleting the app or your account does not cancel your subscription.
Refunds are subject to Apple's or Google's refund policies and must be requested from them. Any statutory withdrawal right for immediately supplied digital services applies only as required by law; your mandatory consumer rights remain unaffected.
Premium is subject to reasonable fair-use limits. We may change prices and subscription features in the future; price changes are announced in advance as required by the stores.
9. Ads and usage credits
The free version has daily usage limits and may show ads. You can earn extra uses by watching rewarded ads. Usage credits and rewards are personal, non-transferable, have no cash value and reset daily. We may adjust limits and rewards to keep the Service sustainable.
10. Intellectual property
The exAI name, logo, design, software and content belong to us or our licensors. As long as you comply with these terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for personal, non-commercial purposes.
11. Termination
You can delete your account at any time in the app via Settings → Delete account (details). We may suspend or close your account if you seriously breach these terms, abuse the Service, or if required by law. If we discontinue the Service entirely, we will give reasonable advance notice.
12. Limitation of liability
The Service is provided “as is” and “as available”, without any guarantee that it will be uninterrupted, error-free or fit for a particular purpose. To the maximum extent permitted by law, we are not liable for indirect damages, loss of profits or data, or decisions you make based on AI output, and our total liability is limited to the amount you paid us in the 12 months before the claim. These limits do not affect liability for intent or gross negligence, or consumer rights that cannot be limited by contract.
13. Apple terms
If you downloaded the app from the Apple App Store, Apple's standard Licensed Application End User License Agreement (EULA) also applies. These terms are between you and exAI, not Apple; we, not Apple, are responsible for the app, its maintenance, support and content. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
14. Changes
We may update these terms. We will announce material changes in advance in the app or by email. Continuing to use the Service after a change means you accept the updated terms.
15. Governing law and disputes
These terms are governed by the laws of the Republic of Türkiye. The courts and enforcement offices of [CITY] have jurisdiction. If you are a consumer, you keep the right to apply to the consumer arbitration committees and consumer courts of your place of residence under Turkish consumer law, and consumers living in the EU keep the protection of the mandatory consumer laws of their country.
